In its charge sheet filed against Tytler in May last year, CBI accused him of “inciting, instigating and provoking the mob” assembled near the Pul Bangash Gurdwara on November 1, 1984.

A court had Wednesday declined to take cognizance of the supplementary chargesheet filed by CBI against Tytler, Congress leader and former Union Minister, in May in the case relating to the 1984 anti-Sikh riots.

According to Section 195 of the CrPc, no court can take cognizance of offences under sections 172 to 188 of the IPC, 'except on the complaint in writing of the public servant concerned'. The matter will be heard on July 21.

Congress leader Jagdish Tytler and businessman Abhishek Verma were put on trial by a city court in Delhi in the case for allegedly using a forged letter addressed to then Prime Minister Manmohan Singh in 2009. The petitions were dismissed by Justice Ashutosh Kumar.
