11-member fact-finding body of questions V-C’s right to set up the same

The 11-member fact finding committee,set up to decide the fate of dismissed lecturer B L Raina,met for the first time on Wednesday. According to it,M S University (MSU) Vice-Chancellor Prof Ramesh Goyal had no power to form the committee. Even as Prof Goyal formed another fact finding committee upon Senate members’ advice,the members objected to it citing a decision of the Gujarat Tribunal in 2005.

The members cited the case of Vijay Raghavan who was removed from Sanskrit Maha Vidhyalaya as lecturer. Raghavan approached the Gujarat University Tribunal opposing the decision of the committee,which was formed by the V-C.

Dinesh Yadav,who is a member of the newly-formed committee,said: “The tribunal had decided in favour of Raghavan on October 28,2005. It clearly specified that V-C has no power to appoint the fact finding committee. Accordingly,amendments were made and the resolution was passed.”

The committee was set up by the V-C when Raina was caught red-handed by the Anti-Corruption Bureau recently. It was formed to decide if he could continue as a lecturer. He was removed from the post of director in-charge of Continuing Adult Education Centre. However,the Senate demanded the formation of another committee,to which the V-C responded by forming another fact finding committee. This had five syndicate members out of 11.

Yadav said,“The committee pointed out as to how the Syndicate,which is a deciding body,could investigate the same issue.”
