A Special CBI court on Wednesday reserved its order on an application by suspended Dy SP N K Amin an accused in the Sohrabuddin Sheikh fake encounter case to turn an approver,till August 26.
The CBI court also reserved the order on a plea of eight other co-accused including suspended IPS officer D G Vanzara opposing Amins application.
Last month,Amin had filed an application for turning approver in the case under the provisions of the Code of Criminal Procedure (CrPC). He has also sought pardon. CBI has shown
conditional willingness to Amins plea,but eight other accused have objected to the same.
On Wednesday,Amins advocate Jagdish Ramani submitted that the objections raised by the co-accused should not be heard. They have no locus standi in the case,he told the court. CBI Counsel Ejaz Khan also took a similar stand and submitted that the co-accused had no right to object to Amins plea.
Advocate S B Vakil,representing Vanzara and the other accused,raised questions about the constitutional validity of Amins plea.
Vakil cited a number of Supreme Court orders to substantiate his contention.
He argued that the special court did not have jurisdiction to record Amins statement under CrPC,which is the first step towards deciding on a person becoming approver.
After hearing the arguments,the court reserved its order till August 26.
