Litigation not adversarial, land a question of security, Pathan tells HC

After the Gujarat High Court on Thursday indicated that it is not inclined to entertain a petition moved by former cricketer and Trinamool Congress MP Yusuf Pathan, challenging a notice by the Vadodara Municipal Corporation (VMC) that ordered him to remove encroachment on a plot, Pathan on Friday told the court not to perceive the litigation as adversarial but rather as a question of security.

The MP from Baharampur in West Bengal had moved an application, requesting to purchase a corporation-owned plot of land at Tandalja in Vadodara adjacent to his residence in March 2012.

According to Pathan, in June 2012, the VMC approved the proposal by issuing a resolution allotting the 978-sq m land to him. However, a notice was served to Pathan on June 6 this year — two days after he won the Lok Sabha election — by the VMC land estate department, informing him that an application regarding the land being allotted to him was sent to the state government seeking its approval to lease the plot of land for 99 years under a special case without conducting an auction.

The state urban development department, on June 9, 2014, rejected the request, which has only been communicated now to him, Pathan alleged.

Senior advocate Yatin Oza, representing Pathan, told the court of Justice Sangeeta Vishen that the 2014 order of the state government rejecting VMC’s proposal of allotment of the plot to Pathan was not communicated and that he had requested for the plot for “security reasons”.

Justice Vishen, however, said, “So, you are placed on a better pedestal than others (for) requiring security? Then apply for Z-security, etc.”

The court will hear the matter again on June 25.
