Registering title to any land,building or house is going to get tougher in the state as the government is planning to enact a new Property Titling Act on the lines of the centres proposed Land Titling Bill,2011.
The purpose of this new enactment is to protect the title of the legitimate owners of the properties and control property related frauds by tampering in the title deed and other related documents. The proposed law will provide for tagging an identity to the properties after a survey,which will be linked up to the Unique Identification project.
Dr S A Golakia,secretary (Revenue),told The Sunday Express,We are reviewing the draft of Land Titling Bill,2011,sent by the Centre. The Government of India has asked for our suggestions on the bill. There are no objectionable things in the bill at present,and we are ready to adopt the law as soon as the centre passes it. We will have to create a separate authority at state and other sub-ordinate levels.
He further said that a committee and a grievance redressal tribunal will be formed. We will have to form special rules and regulations to implement the Act. We hope that by 2012 we will be able to enact this new important Act in the state, Golakia said.
The proposed Act will provide for establishment,administration and management of a system of conclusive property titles through registration of immovable properties and further to amend the relevant acts as stated in the schedule and matters connected with it.
The Union Cabinet has given its approval for introducing the conclusive property titling system and the bill is likely to be cleared by the Parliament by the year-end.
Once the Act is implemented in the state,a Land Titling Authority will be appointed followed by district counterparts.
The government will also appoint title registration officers at taluka and district levels. These officers will prepare digital records of all immovable properties situated in notified area. A survey of record of boundaries of every immovable property duly identified with a distinct identity will be made to connect with the UID project. The preparation of Register of Titles under section (10) (B) will be taken up based on the available land records.
