The Punjab and Haryana High Court,on Wednesday,stayed the order issued by Panjab University to DAV College,Sector 10,to withdraw suspension of Dr B C Josan as principal.
DAV College Managing Committee had moved the High Court opposing the order and sought a stay on the direction by the university. The High Court has also issued notices to Panjab University and Dr B C Josan.
The Committee contended that the Registrar of the university is not competent to pass such a direction. The Committee also challenged the vires of the regulation under which the Registrar had passed the order.
Contending on behalf of the Committee,Advocate Sanjiv Bansal said that the Registrar had exceeded his powers to pass a direction to withdraw Josans suspension. Bansal argued that the Registrar was only asked to give a finding as to whether various charges levelled by the Committee against Josan were correct or not.
The Registrar had no powers to give a direction for withdrawal of suspension, the counsel added.
Panjab University had claimed that it had only given a suggestion and not passed any order to DAV telling them to withdraw Josans suspension.
