In its legal advice to the district administration,the district attorney has said the Panchkula Municipal Council president can continue on the post till the final decision of the court is pronounced.
The Administration had asked for the opinion after the BJP claimed that Rawinder Rawal should be removed as MC president after a local court order,declaring the election to the post illegal. The polls were conducted by the district administration on May 14,2008 and the orders pronounced after BJP councillor V K Sood filed a petition claiming no secrecy was maintained during the election.
Panchkula Deputy Commissioner Pankaj Yadav said: The district attorney has said that according to the Haryana MC Act,the president can continue till the time the final decision of the court is pronounced. We have,however,sent the same to the legal remembrance,the highest legal advisor of the state,for final decision. The case,along with the requests of both the BJP and MC president Rawinder Rawal,has been forwarded to the Haryana Urban Local Bodies,who will now take the final decision.
