Jung-Kejriwal faceoff: Don’t bother LG with all files, orders CM

Days after Lieutenant-Governor Najeeb Jung objected to Chief Minister Arvind Kejriwal’s directive to route files pertaining to police, public order and land through him, the latter has issued another order.

This time the CM has asked all departments of the Delhi government not to “bother the office of the LG” by sending all files to him.In a letter sent on April 29, Kejriwal has directed all departments under the Delhi government to “not bother the office of the Lieutenant Governor” to improve government efficiency.

The CM has made all departments aware of the fact that a decision has been taken that files pertaining to all subjects transferred to Delhi Legislative Assembly under Article 239 AA(3)(A) of the Constitution of India should be decided at an “appropriate level up to the office of the honourable Chief Minister without bothering the office of the L-G”.

In an apparent reply to the Lt-Governor’s letter refusing to route files of police, public order and land through the CM’s office, Kejriwal’s order refers to the Article 74,163 and 167 of the Constitution and Section 41 and 45 of Delhi GNCTD Act 1993.

“It has been observed that despite the analogous provisions referred above, while business of government is run in the name of the President/Governor in states without actually sending files to the Governor in each case, in Delhi the practice of burdening the L-G with all files for continuous approval despite insertion of 239 AA and other articles,” the order read.

Files will now be sent to the Lt-Governor only through the minister concerned, if it pertains to public order, land or police, sources said.

“With respect to reserved subjects — that is, public order, land and police — files should be sent to L-G through ministers concerned and through CM,” the order further said.

The order also states that the decision has been taken to expedite the process of decision-making and governance in Delhi.

The order goes into the details of various provisions of NCT Delhi Act of 1991 and the Constitution that have been examined. It also lists comparisons made of practices of administration being followed with the prevailing practices of other states and the Government of India.
