Custody row: HC comes to rescue of 6-year-old,directs lawyer to know her wish

To ensure the best living conditions for a six-year-old girl whose custody has become a bone of contention between her mother and grandmother,Justice S D Anand has asked a advocate to take the child to his residence and enquire about her wishes.

The directions were passed after Justice Anand observed that the girl,who was present in court on Saturday,was not feeling comfortable in discussing the issue in a courtroom.

Advocate Sunil Chadha submitted that he will take the child to his residence and also get a female lawyer to play mediator so that the child can open up in the friendly atmosphere and express her desire.

As the child is in her grandmother’s custody at present,the court directed the woman to get the girl to the advocate’s residence on Sunday.

The directions were issued in the wake of a case where the grandmother of the girl,a resident of Ludhiana,has been accused of immoral trafficking. The girl’s mother and aunt filed a case in court accusing the grandmother of forcing them into flesh trade.

Taking note of this,the court had ordered a probe in the matter and issued a notice to the woman.

The court had also directed the accused to produce the child in court,as demanded by the mother of the child.

The woman had failed to produce the child on the last two dates of hearing. However,the child was brought to court today.

When the judge asked the child who she would like to stay with,her mother or grandmother,the girl was reluctant and felt uncomfortable.

Advocate Navkiran Singh,counsel for the petitioners,had contended that the child should remain with her mother since serious allegations of immoral trafficking had been levelled against her grandmother.

On the other hand,the counsel appearing on behalf of the accused refuted all allegations. Adjourning the case for a week,the court said it will decide over the issue of custody of the child after advocate Sunil Chadha submits his report.
