While the Mumbai police claims to have cracked the J Dey murder case,they have been unable to pinpoint the motive behind his elimination. The high-profile murder of advocate Shahid Azmi on February 11,2010,is also stuck in such a limbo,with the police unable to unravel the mystery behind his killing.
Four men,all alleged gunmen of now slain underworld don Bharat Nepali gang,pulled the trigger for money,says the chargesheet,but its completely silent on why the contract was actually given. The police,while slapping the stringent MCOCA on the accused,pieced together the immediate motive of pecuniary gains,but the larger motive still remains a secret, said lawyer and Azmis close friend R B Mokashi. MCOCA was later revoked after the special court considered the case unfit to be tried under the Act.
At the time of his murder,Azmi was handling the case of Fahim Ansari,one of the two Indians accused in the 26/11 case. While Ansari was later acquitted by both the trial and the High Court,it was Azmis argument that proved the Mumbai Crime Branch wrong before the court. The chargesheet is voluminous,but surprisingly speaks only about the contract killing. How the assailants came to Azmis office and killed him,all based on a few phone records and witnesses. The crux is still missing, said Azmis brother Advocate Khalid.
The family suspects this will help the defence put up a strong case. With Nepali dead and the prosecution
unable to satisfy the lower court if there was any pecuniary benefits to the accused,the defence might claim the arrested accused are innocent. We are hoping the full bench of the High Court invokes MCOCA again, added Khalid.
