The Bombay High Court on Monday directed subordinate courts,which stayed eviction orders issued to hawkers,to take a fresh decision in accordance with a Supreme Court order restraining hawking in an earmarked no-hawking zone.
The court was hearing a petition filed by Shri Vile-Parle Kelvani Mandal (SVKM),seeking the removal of illegal hawkers from Vile-Parle (West) near the Mithibai College,run by the trust.
Counsel for the trust,V A Thorat and Jamshed Mistry,had told the court that the area was a no-hawking zone,but 26 stalls are being operated by hawkers in the area. The court was informed that the Brihanmumbai Municipal Corporation had taken action against illegal hawkers on March 22,2011. However,they told the court that the evicted hawkers had returned.
The court was also informed that some of the hawkers had secured a stay on their eviction from the Small Causes Court or the City Civil Court.
Earlier,the court had remarked that it was unfortunate that the Supreme Courts order had not been complied with.
The court has now asked the apex courts ruling to be brought to the notice of the courts that have stayed the eviction of hawkers and asked them to take a fresh decision within two weeks.
