The Bombay High Court, on Monday, dismissed petitions challenging the trust vote won by the BJP government .
“While very persuasive arguments have been made. We are not convinced that this matter falls within our jurisdiction. We are inclined to dismiss the petition,” said Justices V M Kanade and Anuja Prabhudessai .
Three petitions including one by former Congress minister and sitting MLA Arif Naseem Khan had been filed seeking dismissal of the BJP government in the state calling it unconstitutional.
While hearing to this matter on Monday, the court had asked, `”Can a writ be issued to the Chief Minister and the Speaker and can direction be issued to?”
The state government had maintained that while voice vote was a rule, division of votes was the exception.
The arguments in this matter had gone on three days. On Wednesday, the court had decided to accept submissions from both the petitioners and respondents.
