In a relief to several Air India employees,the Bombay High Court on Tuesday set aside an order of the City and Industrial Development Corporation of Maharashtra Ltd (CIDCO) which imposed additional conditions on them for availing of government housing in Navi Mumbai.
While rejecting applications of the Air India employees,City and Industrial Development Corporation of Maharashtra Ltd had cited its regulations framed in 2008,which laid down that applicants must have been living in Maharashtra for 15 years at least.
However,the court took note of the fact that the allotments were made according to regulations from the year 1975,when no such stipulation existed.
Of 334 employees who applied for flats,279 were found eligible by CIDCO for allotment of the housing project,which is located in Nerul.
A Division Bench of Justice D Y Chandrachud and Justice R D Dhanuka termed the demand regarding domicile as contrary to law and upheld the contentions of the employees.
The act of imposing a fresh set of conditions is anything but fair, the judges said in their order,while allowing their petition.
