People owning property along nullahs or rivers in the city will be given Transfer of Development Rights (TDR) that will enable them to make constructions on other plots.
Until now,owners surrendering part of their land for construction and widening of drains were given additional Floor Space Index (FSI) as an incentive. This meant they had to carry out constructions at the same plot by going higher but in several cases,plots adjoining nullahs or rivers have restrictions on heights of buildings thus rendering the additional FSI useless.
Under the BRIMSTOWAD project that aims at augmentation of Storm Water Drains,the Brihanmumbai Municipal Corporation (BMC) is carrying the work of widening nullahs and rivers.
Officials said that a number of private properties were those adjoining the nullahs. If the owners want to develop the property they couldnt due to location of the water body close by. Since the civic administration is carrying out widening of nullahs,the owners would have to give part of their property, said a senior official from the SWD department.
If owners are given TDR,it will help them to use the construction rights on other plots or sell it in the open market. The move will encourage the land owners to hand over the land without any hesitation, he said.
The state government has proposed modification in the Maharashtra Regional and Town Planning Act,1966 under which nullah widening and training along with construction of service road will be considered as reservation in the Development Plan and if the owners are not able to consume the FSI then they will be given the benefit of TDR.
