After attracting censure from a special court hearing the 2G spectrum allocation case, the Central Bureau of Investigation Thursday said it would challenge the acquittal of the 17 accused in the Delhi Court.
“CBI will appeal against special court verdict in 2G case in Delhi HC,” CBI spokesperson Abhishek Dayal told PTI.
The investigation agency earlier said that the special court did not appreciate the evidence in its proper perspective and it would take necessary legal remedies.
“Today’s judgement has been prima facie examined and it appears that evidence adduced to substantiate charges by the prosecution has not been appreciated in its proper perspective by the learned court. CBI will be taking necessary legal remedies in the matter,” a CBI spokesperson told ANI.
In a strongly worded judgment, Special Judge OP Saini castigated the CBI for ”misreading” the case. “There is no evidence on the record produced before the Court indicating any criminality in the acts allegedly committed by the accused persons,” he said. “The chargesheet of the instant case is based mainly on misreading, selective reading, non-reading and out of context reading of the official record.”
Saini also accused the CBI of basing its chargesheet on oral statements made by witnesses who did not own up to them while in court.
“The chargesheet is based on some oral statements made by the witnesses during investigation, which the witnesses have not owned up in the witness box,” he said.
Former telecom minister A Raja, DMK MP and Karunanidhi’s daughter Kanimozhi and other accused were acquitted of all charges in the 2G spectrum allocation cases.
