SC rejects plea in Aarushi case

The SC rejected the application moved by an advocate seeking a stay on the transfer of Aarushi murder case.

The Supreme Court today rejected the application moved by an advocate seeking a stay on the transfer or epatriation of the CBI officials probing the sensational killing of teenager Aarushi and her domestic aide Hemraj.

A bench of Chief Justice K G Balakrishnan,Justices J M Panchal and B S Chauhan,said it cannot be expected to supervise and keep giving directions in criminal matters.

Aarushi,the daughter of a dentist couple,and domestic help Hemraj were found murdered at their Noida house on May 16,2008.

“This court cannot supervise various courts or cases in India. The special court will act as per the provisions of the CrPC. If you have any grievance,you go to the special judge or you go to the high court,” the bench said while dismissing the application filed by advocate Ashok Aggrawal.

The advocate had,citing a precedent in Abdul Karim Telgi multi-crore fake stamp paper case,had pleaded that the present investigating officers should not be transferred or repatriated to the parent department pending conclusion of the entire investigation.

The application claimed that due to various extraneous reasons,CBI was transferring several of its investigating officers,thus hampering a fair investigation into the twin murder.

The advocate had earlier moved a petition requesting the apex court to monitor the probe being conducted by CBI.

Citing an earlier precedent,the application claimed CBI had itself on November 16,2004,moved a plea in the apex court seeking a direction that none of its officers involved in the investigation relating to the multi crore Telgi stamp paper racket should be transfered or repatriated to their parent departments.

He wanted the court to pass a similar direction in the Aarushi case.

However,the arguments failed to convince the apex court which directed him to approach the appropriate court for relief.

CBI had earlier submitted a status report on the investigations in a sealed cover and the same comes in the backdrop of fresh allegations that the vaginal swab of Aarushi was tampered with to shield the real accused.
