In deciding to go ahead with the supplementary chargesheet, the CBI chose to ignore the fact that Attorney General Goolam E Vahanvati is still to tender his legal opinion on whether prior prosecution sanction is required in the case of the accused IB officials.
A legal expert said this matter will first arise at the time of framing of charges by the Ahmedabad court. “What is crystal clear is that government wings like the home ministry, CBI, IB, NSA, etc, are not on the same page in so far action against IB officials, retired or otherwise, is concerned,” said a senior official.
Why should ‘beneficiary’ escape: Cong
Chief of the Gujarat Pradesh Congress Committee Arjun Modhwadia said: “A police officer in jail clearly said that all the fake encounters happened under the leadership of the chief minister and as part of the policy of the BJP government, and according to the police officer, these were mere executions of the policy of the government. The larger question then is, why should the beneficiary who gave the orders, be out (of jail)?”
Our stand on amit shah vindicated: BJP
The party sought to project the fact that Amit Shah had not been named by the CBI as a vindication of its stand that there was a “malicious” campaign to implicate Shah in this case.“Today the CBI did not find any evidence against Amit Shah and consequently he was not named in the charge sheet,” BJP leader Ravi Shankar Prasad said. “For last so many years, Congress party had undertaken a malicious, motivated and systematic campaign against (him).”
