CBI must probe all Vyapam cases: Supreme Court

Allowing CBI’s plea, the bench gave it three weeks to take over all the cases and to appoint public prosecutors.

The Supreme Court on Monday said that all cases related to Madhya Pradesh’s Vyapam scam would have to be taken over by the CBI, including cases where investigations are over or trial courts have delivered the final judgment.

“All cases have to go to CBI now even if the investigations are complete and chargesheets are filed. Even where orders of acquittals have been passed by trial courts, you (CBI) will have to read the judgment and see the reasons. People have faith in you. Even the state government has reposed its faith in you,” a bench led by CJI H L Dattu told Solicitor General Ranjit Kumar, who appeared for the agency.

The clarification came after Attorney General Mukul Rohatgi, representing the Madhya Pradesh government, asked the bench to explain whether the CBI also had to take over cases in which chargesheets had been filed by the state police.

Allowing CBI’s plea, the bench, also comprising Justices Kurian Joseph and Amitava Roy, gave it three weeks to take over all the cases and to appoint public prosecutors. In the meantime, the state government will continue prosecuting these cases.

Citing the number of cases — now 212 — Kumar complained about lack of manpower and said there were around 800 vacancies in the agency.
