Army mulling appeal in SC against Adarsh report

Judicial commission report has stated land where the building stands belongs to the state.

The Army is mulling filing an appeal in the Supreme Court against the report of the judicial commission on the Adarsh Society scam,which said the land on which the multi-storeyed build stands belonged to Maharashtra government.

The interim report of the two-member panel,headed by former High Court Judge J A Patil today said the land where the building stands belongs to the state and not the Defence Ministry and that it was not reserved for Kargil war widows.

The Army is studying the interim report,sources said tonight when asked whether it is planning to challenge the report in the apex court.

Any decision on filing an appeal will be taken at an appropriate time after the report is examined,they said.

The interim report was tabled in the Maharashtra state assembly today by Chief Minister Prithviraj Chavan.

“The claim of Maharashtra government stands established in view of the provisions of section 294 of Maharashtra land revenue code 1966,” the report said.

The commission,which gave its report on the limited issues of ownership and whether it was reserved for defence personnel or Kargil war heroes,said,”At the time of arguments,counsel for ministry of defence,state government or even the Adarsh Cooperative Housing Society uniformly submitted that there was no such reservation.”

The panel said it was a final report so far as the terms of references of ownership of land and whether it was reserved for Kargil war heroes was concerned.
