CBI suffered a setback with the Supreme Court rejecting ‘outright’ its plea for transfer from Uttar Pradesh to a Delhi court the trial of the case on ‘fraudulent’ withdrawal of provident fund of Ghaziabad court staff involving judicial officers and sitting judges of Allahabad High Court.
A three-judge Bench of Justices D K Jain,V S Sirpurkar and G S Singhvi said the apprehension expressed by CBI that the trial would not be fair as it involved local judicial officers was not substantiated and appeared to be “bald allegations.”
The Bench said accepting CBI’s plea would amount to undermining the credibility of the entire state judiciary.
“We are of the view that the apprehension entertained by CBI that the trial of the case at Ghaziabad may not be fair,resulting in miscarriage of justice,is misplaced and cannot be accepted.
