Mechanism needed to avoid misuse of UAPA: WB minister

A West Bengal minister and RSP leader,who has been critical of the Left Front government’s stand on Unlawful Activities Prevention Act,demanded a “proper mechanism” to prevent misuse of the Central law.

State PWD minister Kshiti Goswami said a proper mechanism for booking a person under UAPA was necessary to avoid it misuse.

“It is necessary to avoid the misuse of the Act in a Left-ruled state,” said Goswami.

Claiming that it was for the first time that a preventive detention act like UAPA has been implemented in West Bengal under the Left Front Government,Goswami said,”There are some grey areas in the implementation of the central Act”.

“On earlier occasions,the Left Front refused to invoke ESMA”,the RSP leader said. He also recalled an instance when former Chief Minister Jyoti Basu put his foot down on the use of POTA in the state.

“An arrested person must be produced in court within 24 hours but in these days of rapid communication it is possible for the police to inform the state Home Secretary through fax or some other mechanism and obtain his permission before booking a person under UAPA. The Home Secretary then should consult the Chief Minister,” Goswami said.
