NEW DELHI, March 22: The National Human Rights Commission (NHRC) has ordered the Rajasthan Government to pay an interim compensation of Rs 50,000 to the dependents of a person who died due to alleged torture by the state and sought prosecution of the officials concerned.

Commission sources said that the directive was issued after the NHRC took suo-motu cognizance of press reports and asked its investigation wing to probe into the death of Hussain Teli who was taken to the police station in Bonli in Rajasthan for interrogation in connection with a murder case. NHRC held the detention of Hussain as “illegal”.

According to the Superintendent of Police of Jaipur, Hussain was called to the police station for questioning on July 22, 1995 and kept there illegally. A case has been registered against the concerned persons for this offence.

An inquiry conducted by the sub-divisional magistrate revealed that on July 22, after questioning for 22 hours, Hussain was released and on the morning of July 23 he wasfound sitting near the tahsil office and vomiting blood. Hussain was rushed to the district hospital in Sawai Madhopur where he died. The SDM’s report said no external injuries were found on Hussain’s body, but blood was oozing out of his mouth and nose. The investigation wing said “this is a case of death on account of torture by the police during interrogation and the body was buried under unusual circumstances by the police authorities only with a view to cover up their misdeeds.”

“On perusal of records, it is clear that the detention of the deceased in the police station was unauthorised,” NHRC observed, saying there was a connection between the death and the conduct of the police during the investigation.

Steps were being taken to prosecute the officials as cases have been registered against them, the Commission said.
