Apex court cancels bail of ex-MLA in two murder cases

The Supreme Court on Tuesday cancelled the bail of former Gujarat legislator Jayrajsinh Jadeja who is facing trial in two murder cases and is also involved in 10 other criminal cases.

While cancelling Jadeja’s bail in two separate murder cases, a Bench of the apex court, comprising Justice Ashok Bhan and Justice Altmas Kabir, came down heavily on the two judges of the Gujarat High Court for granting him the bail and staying his prosecution in two different murder cases. The Bench ordered the former legislator to surrender before the trial court in his state within seven days, failing which the police was asked to arrest him.

The Bench also set aside the February 2007 order of the High Court, which had stayed the prosecution of the MLA and asked the trial courts to immediately resume the trial and “take it up on a day-to-day basis and conclude the same within six months.” The Bench took note of the fact that the state’s Additional Public Prosecutor (APP) R R Trivedi, who had been entrusted the task of the MLA’s trial in the lower court, had close links with the MLA and had been derailing the trial in overt and covert manner.

However, the Bench expressed satisfaction over the fact that the state has divested the APP from the task of conducting the MLA’s trial and had appointed another APP for the purpose.

Jadeja is accused of murdering two people, Nilesh Rayani and Vinodrai Singla, in 2004 because of enmity. For these two murders,

Jadeja was facing trial in sessions courts of Gondal and Rajkot in Gujarat.
