CHANDIGARH, Jan 25: In a significant order here, the UT Consumer Disputes Redressal Commission set aside the order of the District Forum whereby proprietor, Satnam Refrigerators, had been directed to refund Rs 22,500 to the complainant for allegedly supplying him a defective air conditioner twice. Earlier, in his complaint before the forum, Rajesh Kumar had alleged that he purchased an air conditioner from the party on September 26, 1991, on making a payment of Rs 21,000.The respondent, however, issued a cash memo of Rs 11,900 in respect of price of a compressor. The complainant stated the AC, on installation, turned out to be ineffective. Subsequently, the opposite party delivered another piece to the consumer. This time again a defect was noticed, it was alleged. The Commission Bench comprising president J.B. Garg and member Sada Nand, in their order, stated that perusal of record shows only a compressor was sold by the respondent.It was further stated that there is no indication to the effect that Rs 21,000 had either been paid in cash or through bank and in case an AC had been sold, there was no bar for the complainant to insist for a clear receipt of full price. Holding that no deficiency in services on part of the respondent has been established, the bench accepted the appeal and set aside the said order.
