PUNE, Jan 20: The Pune district consumer disputes redressal forum has ordered Jayant Raghunath Lashkare of Konark Micro-Computers to pay Dhananjay Kudratkar, a resident of Ambegaon, Rs 50,000 along with 18 per cent interest for deficiency in service. It also ordered him to pay Rs 2,000 as compensation for mental harassment and Rs 500 as cost of the complaint, within two months. The order came on a complaint filed by Kudratkar regarding a computer and stabiliser supplied by Konark Micro-Computers to him following an advertisement in a local daily. On reading the advertisement, Kudratkar made enquiries with Lashkare, who quoted Rs 50,000 as the total price of installation of the computer. The condition of the quotation was 50 per cent advance against the order and a cash discount of 4 per cent was also offered. Accordingly, Kudratkar paid Rs 25,000 as advance and Rs 25,000 on April 2, 1993. The same day Lashkare told him that costs of computers had increased due to the new budget and refused to give the 4 per cent discount. The computer was installed without a mouse. An engineer attended to the complaint and accepted to replace the mouse connector. On May 28, the hard disk of the computer started making noise and broke down completely within a month. The hard disk was taken by an engineer for repairs during which the data stored in it was erased. The opponent replaced the hard disk on some conditions, but the noise continued and the computer stopped functioning after June 21.The disk was not replaced by Lashkare and did not keep the warranty. The complainant demanded the refund of Rs 50,000 - the cost of the computer and for compensation of the loss of business at Rs 3,000 per month. The order was passed by president K D Kochargaonkar and members S S Pendse and Sunetra S Oak.
