CHANDIGARH, Oct 30: The Punjab and Haryana High Court while disposing of a contempt petition filed against a sitting judge of the court, has held that there was no violation of Section 18 of the Contempt of Courts Act by the judge.

Justice S C Malte of the court while disposing of the contempt petition filed by petitioner M B Rana against Justice R L Anand of the court, has in his five-page order, instead directed for issuing a show cause notice to the petitioner as to why contempt of court proceedings should not be initiated against him for levelling serious charges against a sitting judge of the court.

In this regard, Justice Malte has further stated that this case be put up before an appropriate bench after obtaining orders from the chief justice. The judge issued the orders against the petitioner after he found that he was in the habit of initiating frivolous and fictitious complaints against various persons and has already been let off by the high court earlier, while taking a lenient view on a contempt case against him.

The contempt petition disposed of was unique as the petitioner had charged Justice R L Anand of the court for contempt. He had also alleged that the judge was not competent to hear the criminal contempt petition against him, as only a division bench of the court could hear the matter once a contempt notice was issued to him. On these charges, Justice Malte held that in view of the Contempt of Court (Punjab and Haryana) Rules, 1974, the petition for motion had been placed before a single bench and there was no question of referring it to the larger bench.
