A Speciall court has asked Police Commissioner A N Roy for permission to invoke the Maharashtra Control of Organised Crime Act (MCOCA) against Mumbai police encounter specialist Sub-Inspector Daya Nayak.The court, hearing complaints filed by former journalist Ketan Tirodkar of a nexus between Nayak and gangland kingpin Chhota Shakeel, has given Roy until April 12 to file a reply.Roy, designated as a competent authority who can sanction use of the MCOCA, must give the reasons for his decision, and may open a new investigation if required.The court has sent case papers to the commissioner, including on Tirodkar’s complaint, former Assistant Commissioner of Police Shankar Kamble’s report on the raids on Nayak’s residence, plus witness statements.At the heart of the case is an alleged attempt by Nayak to extort money from gangster Tariq Nabi. Tirodkar also questions the financing of a Rs 1 crore school in Nayak’s mother’s name and has recounted several instances when he helped Nayak in his ‘criminal activities’ on behalf of Chhota Shakeel. Tirodkar has said that he is ready to face charges himself under the MCOCAMeanwhile, the court today also heard the final evidence of former Deputy Commissioner of Police (Crime), Pradeep Sawant, now in judicial custody in Pune for his involvement in the Telgi stamp-paper scam.So far the case has seen nine witness, several of them high profile witness, which include former police commissioner R S Sharma, and Ronnie Mendonca and Pradeep Sharma.
