CHANDIGARH, Dec 17: Appearing before the court today, Punjab Director General of Police (Home Guard) today claimed that the letter, asking the petitioner to withdraw the writ petition, had not been sent by him.Deposing before Justice T.H.B. Chalapathi, he stated the letter was sent by the Assistant Controller, Finance and Accounts, "without his authority and without bringing it to his notice". The DGP added that appropriate action would be taken against the officer for writing the letter.Meanwhile, claiming no lapse on the DGP's part, the Punjab Deputy Adovocate General added that the officer should not have written "such a letter". Justice Chalapathi, after hearing the arguments, observed: "Let the DGP place before the court the action taken agaisnt the Assistant Controller, Finance and Accounts by January 18." He added: "Depending upon the action, the responsibility of the DGP has to be fixed for issuing the letter. The DGP is further directed to place the entire file before the court.Earlier, the DGP was directed by Justice Chalapathi to be present before the court to show cause as to why contempt of court proceedings should not be initiated against him. The letter, received by petitioner Kulwant Singh, had allegedly asked him to withdraw the writ petition and to give an undertaking against his continuing with any judicial proceeding for getting the retirement benefits. ulwant Singh had earlier filed the application for withdrawal of the writ petition "since he had been asked to submit an affidavit that he had withdrawn the case regarding the compulsory retirement pending in the court".
