GURGAON, January 8: The Haryana Urban Development Authority (HUDA) has served fresh show-cause notices to around 50 plot holders in various urban estates running commercial outlets from residential premises. The violators include owners of private nursing homes, real estate agencies and income tax consultants. The show cause notices have been served under Section 16 of the HUDA Act.

The opening of commercial outlets in residences has been one of the factors which has contributed to the failure of markets and commercial sites in various HUDA sectors. Though many have dismissed the serving of fresh notices as a routine exercise, private medical practitioners and consultants seem to be concerned.

In 1997, the HUDA had evolved a policy of paying one-time fee for running certain professional consultancy services under this policy. It was decided that those professional consultancy services which were inseparable from residential use, like services of doctors, lawyers, architects, tax consultants, who were self-employed and who render important service to the community and any such service which did not create a nuisance, should be included for the mixed land use upto 25 per cent of the covered area of the residential premise or 50 sq m, whichever was less, could be used for running these services. A sum of Rs 50,000 was to be paid for mixed land use in the towns of Gurgaon, Panchkula and Faridabad.

However, the affected groups filed a writ petition in the Punjab and Haryana High Court challenging HUDA’s policy, and the matter is subjudice.
