NEW DELHI, FEBRUARY 7: Senikor BJP leader and Rajmata of Gwalior Vijayaraje Scindia has in her will deprived her only son, Congress leader Madhav Rao, of a share in her property. She has handed over most of it to a trust with one-fifth going to public charity.

short article insert Vijayaraje, who died after a protracted illness on January 25, had fallen out with Madhav Rao during Emergency in 1977 when the latter escaped persecution by joining the Congress. In her autobiography — released three years ago — she had accused Madhav Rao of implicating her supporters in “false cases on instructions of his political masters”.

In her will, she not only deprived him of the property but also of the right to perform her last rites.

“I have not disinherited him though my bequest may show I have done it. But, the hard and true fact is that he has disentitled himself and rendered himself unfit even to the right to cremate his mother’s dead body…Any mother can imagine how painful and agonising it is to disown her only son — but the way my son disowned all that the Scindias stood for in their long struggle in defence of the country left me with no option but to try and forget that I ever had a son,” the handwritten will says.

The will written on September 20, 1985, had Sambhaji Rao C Angre, Rajmata’s personal secretary, and S Gurumurthy, chartered accountant, as joint executors. They were authorised to take charge of her entire estate, including all properties, assets, heirlooms, works of art, jewellery, furnishings and any rights in or over any unpartitioned property.

Rajmata had left photocopies of the will with Angre’s wife, Raj Rajeshwari Devi, Gurumurthy and a British solicitor firm, Lovell White and King, while keeping the original will with the registrar who registered the will the day it was written.

With most of her properties under dispute with Madhav Rao and his son, Jyotirditya, under Primogeniture, it was extremely difficult for Angre to execute the will which is apparently why he made it public.

In fact, Rajmata had set up 18 trusts to look after her properties and most of them have both Angre and Madhav Rao among the trustees. The Vijayaraje Scindia Trust has Gurumurthy, N K Shejwalkar, the then MP from Gwalior, and Dr N M Ghatate as trustees. In her will, Vijayaraje has nominated her three daughters — Usha Rana, Vasundhara Raje and Yashodhara Bhansali — besides Angre as trustees.

She has bequeathed the legal rights to her jewellery to her daughters and said that this should be kept with the collector in the manner and terms as that of the Gaekwad royal family of Baroda.”

The will also allows Dr J K Jain, whose Jain TV studios occupies three acres of the 32-acre Scindia Potteries complex, to continue in the present position. The Jai Vilas Palace in Gwalior, which has been made part of a trust, along with Shanti Niketan, should be converted into an educational centre.

In what had been a battle between Madhav Rao and Angre, the will gives the latter a clear edge. Angre has not only been given two stud farms in Jodhpur but has also earned a lot of praise from the late Rajmata.

She has also acknowledged the founder of The Indian Express, Ramnath Goenka’s support by describing him as a source of inspiration to her and describing him as a person whom she admired for his courage and conviction.

Writing about her estranged son, Madhavrao, the late Rajmata said the relationship constituted the most painful part of her life. “My son not only betrayed the noble values of his forefathers but, for mean and selfish reasons which motivate traders and commercial men in their deal(ings) with the government, surrendered everything that the Scindia family stood for.”

Accusing her son of showing loyalty to his political masters, the late Rajmata charges him with becoming a tool in their hands and mentally torturing, persecuting and humiliating her by diverse means.

“He foisted, by his power and money, false criminal cases on my loyal friends and relatives, merely because they were loyal to me, locked me out of my own house, got my private living apartments raided by the help of the police and his own staff in my absence under the allegation of theft, with the sole objective of humiliating me, his mother.”

Scindia — being in Gwalior for the tehervi of his mother — was unavailable for comments. His lawyer, Abhishek M Singhvi, too declined to comment saying “it is a family affair which should not be discussed in this hour of grief”.
