NEW DELHI, July 1: Former Indian cricket captain Kapil Dev bowled a googly today by failing to appear in court for the third time in connection with a land encroachment case in South Delhi. The magistrate today issued fresh summons for October 20.

On April 4 Metropolitan Magistrate (MM) Vinay Kumar Khanna had summoned Dev to court today. He had asked the investigating officer to personally deliver the summons to the sportstar.

The IO submitted in court today that the summons issued in April could not be served on Dev because he had gone abroad. Based on the complaint of one J.C. Sharma of Asola village in Mehrauli, the police registered a case under Section 447 (criminal trespass) of the IPC against Kapil Dev and his associate Charan Singh in 1996.

The investigation is complete and the police have also filed a chargesheet in court. According to the chargesheet Kapil Dev and Charan Singh encroached on a piece of gram sabha land (Khasra no. 1628 and 1629) by extending the boundary walls of their farm houses at Asola village.
