CHANDIGARH, Jan 29: Convicting M S Shoes East Ltd. and its managing director Pawan Sachdeva under Section 138 of the Negotiable Instruments Act, UT Additional Chief Judicial Magistrate B. C. Gupta today ordered the firm to pay a fine of Rs 13,000 and its MD to undergo a rigorous imprisonment of one year.The MD was also fined Rs 12,000, and in case of default in the payment of fine, he was directed to undergo a further RI of three months. According to the complaint lodged by Ashok Goel, representative of the complainant company Modella Knitwear, the accused had purchased hosiery items from the complainant company against bills between June 10, 1993 and October 26, 1995.It was stated that about Rs 1.53 crore was outstanding against M S Shoes East Ltd. and the cheque for Rs 50 lakh issued by the MD to discharge a part of the liability, was dishonoured on account of insufficient funds in the said account. It was further stated that the accused failed to respond to the notices served to them. A complaint was subsequently lodged after the expiry of 15 days of issuance of notice.Directors of the accused firm, Sadhna Sachdeva and Krishna Sachdeva, were today acquitted by the court.
