CHANDIGARH, Feb 8: Former Sikh Gurdwara Judicial Commission member Dara Singh’s application challenging the order restraining Manjit Singh Calcutta from functioning as the SGPC’s senior secretary, was dismissed as withdrawn by a division bench of the Punjab and Haryana High Court.
In an oral request before the bench, comprising Justice G.S. Singhvi and Justice Amar Dutt, Dara Singh’s counsel stated that the applicant did not wish to press the prayer. Dara Singh, in his petition, had earlier stated that the “very constitution” of the Judicial Commission had been challenged. The writ, he had added, was pending in the court and was to come up on February 23.
The High Court, on an amended petition filed by Dara Singh, had earlier issued notice to the Union of India, besides the state of Punjab for February 23.
Challenging the Punjab government notification removing him and others, he had stated that state government did not have the power to adopt such course of action under the Sikh Gurdwaras Act.
