
CHANDIGARH, July 30: Following the dismissal of Superintending Engineer K.B. Sharma’s anticipatory bail plea by the Punjab and Haryana High Court, the UT Vigilance Department today moved an application for issuing non bailable warrants against him.
Taking up the application, UT Judicial Magistrate (Ist Class) Jasbir Singh issued notice to the defence counsel for August 1.
The warrants, earlier issued against him on June 13, were recalled by the magistrate on July 18, on the defence counsel’s plea. The counsel had stated that Sharma was not absconding and had rejoined the office.
Today, seeking re-issuance of the warrants, the assistant district attorney stated that the officials of the Vigilance Department had failed to trace him even after raiding his residence and suspected hide-outs.
Alleging evasion of arrest by the accused, he added that Sharma was not even attending his office. A letter, claimed to have been written by the UT Chief Engineer, was also enclosed to substantiate the contention. The counsel further stated that his plea seeking anticipatory bail had already been dismissed by the Punjab and Haryana High Court.
It may be recalled that Vigilance Department, after the non-execution of the warrants, had moved an application for declaring him a proclaimed offender and to attach his property.
Refuting the Vigilance Department’s plea, the defence counsel had stressed that Sharma had been granted ad interim anticipatory bail. Further, he was not an absconder as legal remedies were being pursued by him.
Sharma was earlier booked under the Prevention of Corruption Act in the engineering department kickbacks case on the basis of certain diaries recovered from the residences of the alleged middlemen during raids by the income tax authorities in November.
