In a major blow to the Maoists Government,the Nepal Supreme Court has reinstated eight top Army Generals by putting on hold the Government decision to retire them.

The Court issued an interim order on Tuesday asking the Maoist Government to put on hold its decision to retire eight army Brigadier-Generals,even though the Army Chief and Headquarters had recommended extension of their tenure by three years as provided by the Army act 2006.

A single bench of Justice Kalyan Shrestha stayed the Government order on a joint petition filed by the Generals seeking nullification of the decision and extension of their tenure.

The ouster of Generals has sparked off a running battle between the Government and some of its coalition partners and the opposition,who saw in Maoists action a ploy to politicise the armed forces.

The apex court order staying the Government decision comes ahead of a final verdict which the court said it will give after going through the petitions filed by officers. In the petition filed on Tuesday,the Generals had made the Prime Minister’s Office,the Defence Ministry,the Chief of the Army Staff and Nepal Army defendants claiming that the non-extension of their tenure violated the Army Act 2006 and Army Regulations and wanted it should be rolled back.
