NEW DELHI, January 28: A judicial inquiry has been ordered today against a Special Cell inspector for allegedly illegally detaining a man in the Ashok Vihar police station for 12 hours, beating him up, demanding Rs 4 lakh from him and threatening to implicate him in a false case.

short article insert Kamal Saini — a resident of A-436 Shastri Nagar — wrote to Special Commissioner of Police S. Ramakrishnan yesterday alleging that he was beaten and harassed by Inspector Paras Nath. Saini works as a clerk in the billing section of the Divisional Railway Manager’s office.

Saini filed an application for anticipatory bail yesterday. Additional Sessions Judge (ASJ) R.C. Yadhuvanshi stated in his order today that an inquiry be initiated by the concerned Metropolitan Magistrate.

According to Saini, at around 8 a.m. on Sunday morning Nath and five to six other policemen arrived at his home, started abusing and beating him before dragging him out of the house and taking him to a building behind the Ashok Vihar police station in a white Gypsy.

The police claim that they had taken Saini in for questioning, after a complaint was filed by one Kamta Prasad alleging that Saini would “induce people to get jobs in the Railways and then cheat them”. The ASJ, however, said in his order: “Photocopy of the said complaint shows that it was not properly registered in the office of the Special Cell nor is it endorsed by any senior officer.”

The judge also directed that Saini is not to be arrested and he can only be called in for questioning after a notice of seven days has been issued to him.

Saini claims that he was harassed at the behest of one Rajender alias Dana, who works in the electricity division of the Railways and has cases registered against him in Paharganj. According to his complaint, the inspector next called Dana to the police station and they started beating him up again.

In his complaint Saini also alleges that Nath and Dana demanded Rs 4 lakh from him, and asked him to deliver the money on February 2 at Vishal Cinema. Nath said that he would implicate Saini in a false case and put him in the same cell as some Punjab terrorists if he didn’t pay up. The police finally let Saini go nearly 12 hours after he was detained, at 9.30 p.m.
