NEW DELHI, May 26: Former premier Rajiv Gandhi was among those who received kickbacks in the Rs 420 crore HDW submarine deal of 1987, a petitioner alleged before the Delhi High Court on Monday.

A division bench comprising acting chief justice, Mahinder Narain, and Justice S K Mahajan, issued notices to CBI, the cabinet secretary and the home ministry on the allegation of the petitioner, B L Wadhera, that CBI probe into the deal was tardy. The respondents were asked to reply within three weeks and the matter would come up for further hearing on August 5.

Wadhera said CBI had registered an FIR in March 1990, naming among others industrialist Gopi Chand Hinduja but “has slept over it” since then.

He told the bench that seven per cent commission was paid to agents and middlemen by the HDW company in Germany. Therefore the company refused to reduce the price of submarines, as requested by the finance ministry.

Wadhera submitted material relating to the HDW case to the court in a closed cover, which allegedly was V P Singh’s statement before the Jain commission of inquiry. He said the name, which was not mentioned in the FIR registered by CBI in March 1990, was mentioned by Singh before the commission.
