The Centre on Monday has filed a suit in the Supreme Court against the State government under Article 131 of the Constitution of India with regard to the terms of reference of the Justice S.P. Kurdukar Commission inquiring into the Government of India’s decisions in Dabhol project. The Centre, which has already challenged the Kurdukar Commission’s jurisdiction, has sought an interim relief from the apex court whereby the proceeding of the Kurdukar Commission can be stayed.

Power ministry sources said that the Centre’s plaint may come up for an admission within next two days. Attorney General Soli Sorabjee would appear for the Centre. Sources said that the Centre filed its suit after seeking AG’s advice. The Centre had already informed the Kurdukar Commission that the apex court would have the original jurisdiction to decide such dispute under Article 131. The Centre in its suit has reiterated that the Maharashtra government has no authority to set up a Commission of Inquiry in respect of Centre’s decisions/permissions, concurrences, sanctions and approvals granted by its various agencies.
