Congressman Chandrakant Bathu Srivastava, his cousin and BJP MLA Madhu Srivastava, and brother of Best Bakery case witness Zaheera Sheikh, Nafitullah, were among 11 people who were issued notices by the Supreme Court today on the basis of a report prepared by its Registrar General.
The report prepared by B M Gupta, who inquired into the conflicting statements of Zaheera in the case, had indicted her as a ‘‘self-condemned liar.’’
The notice was issued by a bench comprising Justice Arijit Pasayat and Justice H K Sema, which sought their reply within three weeks. The matter will now come up for hearing on November 21.
Others who were issued notice include Advocates Atul Mistry and Shailesh Patel, and Bharat Thakker, brother of an accused in the riots case, Bhagesh Jha, Mir Desai.
The court asked Zaheera’s counsel P N Lekhi and Senior advocate Harish Salve, who is amicus curiae in the matter, to suggest whether report could be accepted or not. Lekhi said the report was not acceptable and “it is worth rejecting”.
Notice to Bofors, CBI
NEW DELHI: The Supreme Court today issued notice to Swedish gunmaker Krtongen Kemi Forwalting AB, popularly known as A B Bofors, and CBI in the politically sensitive Rs 64 core kickback case.
The notices were issued by a bench headed by Chief Justice R C Lahoti on a Special Leave Petition (SLP) by Advocate Raj Kumar Pandey. Pandey has challenged the CBI not appealing against the Delhi High Court order quashing the case against the scam accused.
Contending that the charges against the accused were framed on the directions of the High Court, he said the HC had erred in altering its own final order. Section 362 of the CrPC specifically prohibited courts from altering its final judgements, he added. —ENS
