The Supreme Court has ordered the regularisation of job of a visually impaired person, Bhudev Sharma, who had appeared for the Class-III post of lower judiciary in Bulandshahr in 1992 but was not appointed on technical grounds despite being eligible for the same. A Bench comprising Justices A K Mathur and Markandey Katju allowing Sharma’s appeal, directed the concerned authorities to regularise his services with all consequent benefits.

Relying on the UP Government’s order which reserved 2 per cent posts for physically handicapped persons for direct recruitment in all groups of Government services, Sharma challenged his non- appointment despite falling under the said quota. The Bench said as there were 30 posts altogether for which selection was being held and the state Government had reserved two per cent of the posts for physically handicapped persons for direct recruitment, Sharma was eligible for appointment. “Since 2 per cent of 30 is 0.6 which is more than half, we can say that one out of the 30 posts was reserved for physically handicapped persons. As there was no other physically handicapped person who had applied, the Appellant was entitled to the job,” the order said.
