
After private schools in Delhi, it’s the turn of unaided schools in Rajasthan to oppose the uniform guidelines put in place by the Rajasthan High Court to regulate pre-nursery and nursery admissions.
Accepting their appeal, the Supreme Court on Friday stayed the High Court order on issuing such guidelines and other directives.
Hearing the plea of Society for Unaided Private Schools of Rajasthan, a bench comprising Chief Justice K G Balakrishnan and Justice R V Raveendran issued an interim order not to implement the directive till the next date of hearing.
Issuing notices to the respondents, the bench then posted the matter for further directions to December 7.
The petitioners submitted that the report of the Committee headed by CBSE Chairman Ashok Ganguly was only meant for the National Capital Territory and could not be applied in Rajasthan. It challenged the Rajasthan High Court guidelines, which included a uniform admission calander and a uniform registration form for all the schools with restrictive conditions and a selection criteria based on a hundred-point formula for rating applicants.
The guidelines also laid down the norms for appointment and composition of an Admission Committee in each school. However, it objected to the guidelines’ clause that the district education officer shall be empowered to look into complaints filed by parents against the decision of an Admission Committee.
According to the guidelines under scrutiny, the officer, after conducting an inquiry should submit his report to the Director, Elementary Education,
Rajasthan, who would then pass an appropriate order.
