GURGAON, March 28: Additional Sessions Judge Raminder Jain today dismissed the anticipatory bail application of former Haryana PWD Minister Dharamvir Yadav. Dharamvir was granted interim bail on March 24, till March 27, following the registration of a criminal case against him on March 19.

The complainant, Saraswati Yadav, had alleged that she and her husband, Rajinder Yadav, were manhandled, slapped and threatened by the former minister. Rajinder Yadav is Dharamvir’s former political secretary and a close relative. A case against the former minister was registered under sections 341, 323 and 506 of the IPC for wrongful restraint, voluntarily causing hurt and criminal intimidation.

Moving the application for anticipatory bail, Dharamvir’s counsel argued that all the offences except those under Section 506 of the IPC were bailable and Section 506 had been levelled against Dharamvir to make his offences non-bailable. He contended that under ordinary circumstances any victim would directly approach the police station, but in this case the complainant chose to present the application to the Deputy Inspector General (DIG) and not to the Station House Officer (SHO) of the concerned police station. He contended that moving the complaint application before the DIG shows that a false case has been registered against Dharamvir Yadav for political motives.

The public prosecutor, assisted by the counsel for the complainant, argued that the accused tried to misbehave with the complainant and when she did not accede to his demands, he resorted to violence.

Additional Sessions Judge Raminder Jain, in his order, said that in view of the totality of the facts presented he did not find it a fit case to grant anticipatory bail. He observed that in Indian society, no woman levels such allegations against a person unless there was reason to and there are no circumstances at this stage to disbelieve the complainant’s version.
