MUMBAI, MARCH 31: A judge of the City Civil and Sessions Court, Subhash Raghuvir Jaiswal, has been dismissed from services, with the state government issuing the order on the recommendation of the Bombay High Court administration.

The dismissal order was served on Jaiswal on Thursday, and was he paid his dues, including a month’s salary in lieu of the notice period.

Jaiswal had been appointed as a Civil and Additional Sessions Court judge on a year’s probation on April 29, 1995, and for the last five years, his probation was extended thrice. He was not confirmed in his post till his dismissal on Thursday.

The official reason cited in the order issued by V D Malvankar, joint secretary, Law and Judiciary Department, was that he was being dismissed because he was unable to “successfully complete his probation”.

Jaiswal, it is learnt, practised in the Andheri Metropolitain Magistrate’s Court before his elevation as a judge. It is also rumoured that he was accused in a murder before his nomination as a judge.

Jaiswal is also facing an inquiry ordered by the high court into alleged misconduct involving his building located in Jogeshwari, which he had allegedly set on fire to evict tenants.

The complaint had been lodged by advocate M P Vashi on the basis of submissions made by a client who was one of the tenants. Both Vashi and his client had been summoned as witnesses in the inquiry.

Sources said the inquiry had prima facie established “misconduct” on the part of the judge. Since his appointment had not been confirmed, the high court recommended his removal from judicial service.
