The court said this ordinance be issued by the Central Government within a period of two months as this involved more than one state. “We hope that the state government and Central government will both have the authority to pass a legislation to control the menace in the interest of the society,” the judges said.

The court also desired that the Central government utilise its machinery and several investigating bodies to check the menace prevailing in several states, and, if necessary, by the Central Bureau of Investigation (CBI). The Bench directed setting up of a Central government laboratory in Uttar Pradesh preferably in Ghaziabad which could help determine milk adulteration.

The court asked that the police authorities should cooperate with the health department whenever and wherever need be in connection with the seizure and investigation of synthetic milk. The court also desired that all the cases pending before the subordinate judiciary all over Uttar Pradesh relating to milk adulteration be disposed of within six months preferably within a period of three months. The proceedings of the cases would be taken up on a day to day basis.

The court felt that in public interest milk supervisory committees should be formed in all the districts of the state which would be presided over by the district magistrate and the chief medical officers of the districts.
