
SHIMLA, Aug 20: The HP High Court today acquitted a school teacher who had been convicted and sentenced to seven years’ imprisonment on the charge of rape.
Justice R.L.Khurana accepted the appeal filed by Bimlesh Kumar, centre head teacher in the government primary school Huran in Kullu district. He was sentenced by the additional sessions judge Kullu in May 1995.
He was accused of raping a minor Class V student in the school. The alleged incident occurred on December 7, 1992. The high court concluded that the medical evidence did not support the charge of rape as there were no signs of violence on the person of prosecutors.
Even the delay in lodging the FIR could not be well explained. Moreover, the girl had been attending classes in the school even from the very next day of the alleged occurrence.
The high court held that the prosecution had failed to prove the charge against the teacher. Jagdish Vats appeared for the appellant and assistant AG for the state.
