The Bombay High Court yesterday ordered the Colaba police station to act on a complaint filed against allegedly obscene and pornographic photographs displayed at an exhibition at Jehangir Art Gallery.
The division bench of Justice Ranjana Desai and Justice S K Shah were hearing a petition filed by Sangita Punekar of the Forum Against Child Sexual Exploitation and advocate Vidya Manjrekar against the exhibition put up by the Photographers Guild of India between Dec 8-13.
The petitioners said that on October 11 they lodged a complaint in respect of the ‘‘obscene, provocative, lasciviously pornographic photographs’’ to be exhibited. However, the police did not taken cognisance of the same. The complaint was lodged under provisions of the Young Persons Harmful Publications Act 1956, Indian Penal Code 1860 and the Indecent Representation of Women (Prohibition) Act 1986. The petitioners said they were compelled to move the High Court seeking directions against the police station. Advocate Pradeep Havnur appeared for the petitioners.
The petitioners, referring to a newspaper showing children at the exhibition, said the little ones were being exposed to ‘‘a horrendous display of body parts in compromising positions, including homosexuality and lesbianism activities.’’
The bench observed, ‘‘Prima facie it is confirmed that certain obscene photographs are displayed in the exhibition.” The bench was told that following the oral complaint, the Gallery authorities had removed two photographs of Vikram Bawa. The bench said that since the exhibition is to close at 7 pm, there is hardly any time to take necessary steps. However, the judges directed the Senior Inspector, Colaba police station, to take necessary steps according to law.
