CD row: HC dismisses plea for probe

Refusing to treat it as a public interest litigation (PIL),the Delhi High Court on Wednesday dismissed a petition seeking probe by the Bar Council of Delhi into the alleged CD row,purportedly involving senior advocate and Congress leader Abhishek Manu Singhvi.

Also doubting the credentials of the petitioner working as a clerk in a lower court the court noted that such a plea could not be entertained when the matter between the lawyer and his former employee has been settled in a judicial proceeding.

The petitioner,on one hand,wants action against the employee and on the other,action against the said lawyer for not taking action against this employee. Such pleadings cannot make it a PIL. BCD or Delhi High Court Bar Association is not empowered to take action against an employee of an advocate, a Bench headed by Acting Chief Justice A K Sikri said.

The court shot down the argument that the entire legal fraternity was offended by the alleged acts of Singhvis employee with respect to allegedly creating the CD. The court underlined that it was not a lawyer who had come forward by filing the petition but again a lawyers employee was seeking an order.

The petition was filed by one Sanjay Kumar,who was disclosed by his lawyer Sugriv Dubey as a person working in a Delhi court and also doing social services. The petition sought an inquiry into the CD row allegedly pertaining to Singhvi and a woman lawyer of the Delhi High Court.
