Kalas sister Savita, who lacked the financial resources to bring up the three children, agreed to give their custody to Govind.

Govind then filed a plea in a Surat court seeking to become the legal guardian of these children. Savita also submitted an affidavit in the court stating that Govind had no financial problems and that he could take better care of the three children. The court also listened to the three children who expressed their wish to stay with their uncle.
