Embattled Bihar Chief Minister Nitish Kumar got a breather after the Patna High Court Monday stayed the summons issued to him by a lower court in connection with a 1991 murder case.
Justice Sheema Ali Khans bench stayed the summons and proceedings in the case (131/1991) calling it violation of previous High Court order. The High Court had earlier stayed the proceeding in the case till further orders on April 22.
Bihar Advocate General P K Sahi said the court order was on expected lines. The Barh court order was illegal and void. The summons,though directed to be served by the Barh court,was not served to the CM in any case as the requisite court fee was not submitted to the court by the complainant Ashok Singh. JD(U) state president Rajiv Ranjan alias Lallan Singh too welcomed the stay order. The court order vindicated our legal stand. The lower court in any case should not have taken up the matter once it was stayed by the HC.
Additional Chief Judicial Magistrate,Barh had on September 2 issued summons to the Chief Minister and former RJD leader Dularchand Yadav directing them to appear before it September 9 in connection with the killing of a voter Sitaram Singh during a 1991 by-poll.
Though Kumar and Yadav were dropped from the final chargesheet filed in the case in 1993,one Ashok Singh in August this year moved the Barh court challenging dropping of the duos names from the chargesheet.
Taslimuddin supporters quit RJD
KISHANGANJ (Bihar): Throwing weight behind their leader,supporters of former Union minister Md Taslimuddin on Monday resigned from primary membership of the RJD in Kishanganj district. According to partys district working president Usmal Gani,hundreds of RJD workers,ranging from panchayat to district level,quit the party en block in support of Taslimuddin. We have decided to go with the decision of our leader Taslimuddin, he said and claimed that the RJD had lost its base in the district. Taslimuddin had resigned from the RJD last month charging party supremo Lalu Prasad Yadav with virtually usurping the organisation. PTI
