Machil: Army to file another plea for court martial

Principal and Sessions Judge,Baramulla,had upheld the order of CJM court.

The Army is set to file another revision petition against the order of a Sessions court rejecting the court martial of accused Army personnel in the Machil fake encounter case. Principal and Sessions Judge,Baramulla,on Friday had upheld the order of CJM court and directed all the accused to appear before the court for further trial in the case. Soon after the judge upheld the CJM’s order,the Army moved an application at Sopore court seeking one month’s time to compile an appeal against the Sessions court’s order.

“We are filing a revision petition against the court order,” said Central government’s senior counsel,who represents

the Army in the Machil fake encounter case. “We have already moved an application with CJM Sopore.”

The CJM Sopore while accepting the application for revision petition has listed the case for December 31. This is the second time when the Army has filed a revision petition. Earlier,it had filed a revision petition in June seeking custody of the persons arrested by the police in the fake encounter case. On December 13,the judge had upheld the CJM’s order and rejected the court martial trial of the accused.
